These Terms of Service apply to all users of the site, including without limitation browsers, customers, vendors, merchants, and contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, placing an order, submitting information, or otherwise using our Service, you agree to be bound by these Terms. If you do not agree to all terms and conditions of this agreement, you may not access the website or use any services.
Any new features, products, services, or tools added to the current store shall also be subject to these Terms of Service. You can review the most current version of the Terms at any time on this page.
We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
Our store is hosted on Shopify Inc., which provides the online ecommerce platform that allows us to sell our products and services to you.
Section 1 — Online Store Terms
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any minor dependents to use this site.
You may not use our products, website, or Service for any illegal or unauthorized purpose. You may not, in the use of the Service, violate any laws in your jurisdiction, including but not limited to copyright, trademark, privacy, consumer protection, or ecommerce laws.
You must not transmit any worms, viruses, malware, harmful code, or destructive technology.
A breach or violation of any of these Terms may result in immediate termination of your access to the Service.
Section 2 — General Conditions
We reserve the right to refuse service to anyone for any reason at any time, subject to applicable law.
You understand that your content, excluding payment card information, may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Payment card information is encrypted during transfer and is processed through Shopify and/or approved payment processors.
You agree not to reproduce, duplicate, copy, sell, resell, scrape, exploit, or commercially use any portion of the Service, use of the Service, access to the Service, or any content on the website without our express written permission.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.
Section 3 — Accuracy, Completeness, and Timeliness of Information
We make reasonable efforts to provide accurate and current information on our website. However, we are not responsible if information made available on this site is inaccurate, incomplete, outdated, or contains typographical errors.
The material on this site is provided for general information only and should not be relied upon as the sole basis for making purchasing decisions without reviewing all applicable product details, policies, measurements, shipping information, and other relevant information.
This site may contain historical information. Historical information is not current and is provided for reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information except as required by law.
Section 4 — Modifications to Products, Services, and Prices
Prices for our products are subject to change without notice.
We reserve the right at any time to modify, update, discontinue, or suspend any product, service, feature, page, promotion, or content without notice.
We shall not be liable to you or any third party for any modification, price change, suspension, discontinuance, or unavailability of the Service or any product.
Section 5 — Products and Services
Certain products or services may be available exclusively online through the website. These products may have limited quantities and are subject to return, exchange, cancellation, and warranty terms according to our applicable policies.
We have made every effort to display as accurately as possible the colors, images, materials, finishes, and details of our products. However, we cannot guarantee that your device or monitor will accurately display color, grain, texture, finish, or scale.
We reserve the right, but are not obligated, to limit the sale of our products or services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis.
We reserve the right to limit quantities of any products or services that we offer. All product descriptions, availability, shipping estimates, and pricing are subject to change at any time without notice, at our sole discretion.
We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
Section 6 — Natural Materials, Handmade Products, and Product Variation
Many of our products are handmade from natural materials, including solid wood, teak, reclaimed wood, live-edge wood, suar wood, boat wood, root wood, and other organic or hand-finished materials.
Because of the nature of these materials and construction methods, variations are expected and are part of the character of the product. These may include, but are not limited to:
- Variations in color, tone, texture, and grain
- Knots, mineral marks, natural imperfections, and organic markings
- Checking, hairline cracks, seasonal movement, and natural expansion or contraction
- Distressing, worn paint, weathered areas, patches, or rustic characteristics
- Differences in live-edge shape, root shape, slab shape, or one-of-a-kind forms
- Slight variations in size, dimensions, weight, finish, or construction
- Differences between product photos and the exact item received
These natural characteristics and variations are not considered defects unless otherwise determined by Chic Teak Inc. in accordance with our applicable warranty or return policies.
Product photos are intended to represent the general style, construction, and character of the item. For natural, rustic, handmade, reclaimed, live-edge, root, or one-of-a-kind products, the exact item received may vary from the photos shown.
Section 7 — Product Availability, Backorders, and Lead Times
Product availability, lead times, shipping times, and estimated delivery dates are estimates only and are not guaranteed.
Some items may become unavailable, delayed, discontinued, damaged, backordered, or otherwise unable to ship after an order is placed. This may occur due to inventory discrepancies, supplier delays, freight delays, import delays, quality control issues, or other circumstances outside our control.
If an item becomes unavailable or delayed, we may contact you with available options, which may include waiting for restock, selecting an alternative item, modifying the order, or canceling the affected item for a refund.
We are not responsible for delays caused by suppliers, carriers, customs, weather, natural disasters, labor issues, port delays, incorrect customer information, delivery restrictions, or other circumstances beyond our reasonable control.
Section 8 — Accuracy of Billing, Shipping, and Account Information
We reserve the right to refuse, cancel, or limit any order you place with us.
We may, in our sole discretion, limit or cancel quantities purchased per person, per household, per business, per shipping address, per billing address, per payment method, or per order. These restrictions may include orders placed by or under the same customer account, the same payment method, and/or orders using the same billing or shipping address.
We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, distributors, freight forwarders, or other unauthorized commercial buyers.
You agree to provide current, complete, and accurate purchase, account, billing, shipping, phone, and email information for all purchases made through our store. You agree to promptly update your account and order information so that we can complete your transaction, arrange delivery, and contact you as needed.
You are responsible for ensuring that your shipping address, delivery contact information, phone number, and email address are accurate. We are not responsible for delays, additional fees, failed deliveries, storage fees, return freight, or other issues caused by incorrect, incomplete, or outdated customer information.
Section 9 — Order Errors, Pricing Errors, and Cancellations
Occasionally, information on our website or in the Service may contain typographical errors, inaccuracies, omissions, inventory errors, shipping calculation errors, or pricing errors. These may relate to product descriptions, dimensions, images, pricing, promotions, discounts, shipping charges, transit times, availability, or other order details.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information in the Service is inaccurate at any time, including after you have submitted an order and received an order confirmation.
We reserve the right to cancel or refuse any order due to pricing errors, inventory errors, product description errors, shipping calculation errors, suspected fraud, unauthorized reseller activity, payment issues, delivery restrictions, or other circumstances affecting the order.
If your order is canceled after payment has been processed, we will issue a refund for the canceled portion of the order.
Section 10 — Shipping, Freight Delivery, and Customer Responsibilities
Large furniture items may ship by parcel carrier, freight carrier, LTL carrier, local delivery service, white glove provider, or another delivery provider selected by us or our shipping partners.
Unless otherwise stated in writing, delivery is curbside and does not include inside placement, unpacking, assembly, debris removal, movement up or down stairs, elevator handling, long-distance carrying, or placement in a specific room or outdoor area.
Customers are responsible for ensuring that the delivery location is accessible and that items will fit through gates, driveways, doors, hallways, stairways, elevators, and other access points. Customers are also responsible for providing accurate delivery information and being available for scheduled delivery appointments when required.
Additional charges may apply for missed appointments, redelivery, storage, remote delivery locations, limited-access locations, address changes, refused shipments, return freight, special delivery requirements, or services not included in the original shipping quote.
Customers should inspect all shipments upon delivery. Any visible damage, shortage, missing item, or delivery irregularity should be noted on the delivery receipt before signing. Photos of the packaging and product should be taken whenever possible.
Failure to inspect and document damage or shortages at delivery may limit our ability to file a carrier claim or provide a remedy.
Please refer to our Shipping Policy for more detailed shipping and delivery terms.
Section 11 — Returns, Refunds, and Exchanges
Returns, refunds, exchanges, cancellations, and related remedies are governed by our Return Policy, Refund Policy, Shipping Policy, Warranty Policy, and any written terms provided with the product or order.
Certain products may be final sale, custom, special order, clearance, oversized, used, open-box, or otherwise ineligible for return unless required by law or approved by Chic Teak Inc. in writing.
Returned items must be in the condition required by our Return Policy and must be returned using approved methods and packaging when applicable.
Shipping charges, return freight, restocking fees, or other costs may apply as described in our policies or as otherwise permitted by law.
Section 12 — Warranty and Product Care
Product warranties, if applicable, are governed by our Warranty Policy or the written warranty information provided with the product.
Damage or issues caused by misuse, abuse, neglect, improper assembly, improper maintenance, unauthorized modification, improper storage, normal wear and tear, commercial misuse, exposure outside the product’s intended use, failure to follow care instructions, or natural characteristics of wood are not covered unless otherwise required by law.
Natural checking, weathering, color changes, grain variation, seasonal movement, surface variation, rustic distressing, and other natural characteristics of solid wood or reclaimed materials are generally not considered defects.
Some products may require assembly, maintenance, care, sealing, oiling, protection from standing water, use in covered areas only, or other care steps depending on the item and material. Customers are responsible for reviewing and following all applicable product instructions, care information, and warranty requirements.
Section 13 — Optional Tools and Third-Party Services
We may provide you with access to third-party tools, apps, platforms, payment services, review services, analytics tools, advertising tools, or other third-party services over which we do not have full control.
You acknowledge and agree that we provide access to such tools and services “as is” and “as available” without warranties, representations, or conditions of any kind and without endorsement, except where expressly stated.
Any use by you of optional third-party tools or services offered through the site is entirely at your own risk and discretion. You should review and understand the terms and privacy practices of the relevant third-party provider.
We may also offer new services, features, tools, or resources through the website in the future. Such new features and services shall also be subject to these Terms of Service.
Section 14 — Third-Party Links
Certain content, products, tools, or services available through our Service may include materials from third parties.
Third-party links on this site may direct you to websites that are not owned or controlled by Chic Teak Inc. We are not responsible for examining or evaluating the content, accuracy, policies, security, or practices of any third-party website or service.
We do not warrant and will not have any liability or responsibility for third-party materials, websites, products, services, or transactions.
Please review third-party policies and practices carefully before engaging in any transaction. Complaints, claims, concerns, or questions regarding third-party products or services should be directed to the third party.
Section 15 — User Comments, Reviews, Feedback, and Submissions
If you submit reviews, testimonials, photos, comments, feedback, suggestions, contest entries, creative ideas, proposals, plans, or other materials, whether online, by email, by postal mail, through a review platform, through social media, or otherwise, you agree that we may use, edit, copy, publish, distribute, translate, display, and otherwise use such submissions in any medium, subject to applicable law and our Privacy Policy.
By submitting a review, testimonial, photo, or other content, you confirm that your submission reflects your honest opinion and actual experience. You may not submit false, misleading, defamatory, infringing, unlawful, obscene, abusive, threatening, or otherwise inappropriate content.
If any review, endorsement, testimonial, or submission is provided in exchange for a discount, incentive, free product, payment, or other material benefit, that connection must be clearly disclosed.
You agree that your submissions will not violate any right of any third party, including copyright, trademark, privacy, publicity, personality, or other personal or proprietary rights.
You further agree that your submissions will not contain malware, viruses, false information, or content that could affect the operation of the Service or any related website.
We may, but have no obligation to, monitor, edit, refuse, or remove content that we determine in our sole discretion violates these Terms, applicable law, or the rights of any party.
You are solely responsible for the content and accuracy of any submissions you make. We take no responsibility and assume no liability for any content posted by you or any third party.
Section 16 — Personal Information
Your submission of personal information through the store is governed by our Privacy Policy.
Please review our Privacy Policy to understand how we collect, use, disclose, and protect personal information.
Section 17 — Intellectual Property
All website content, including but not limited to text, product descriptions, product names, photographs, graphics, logos, videos, page layouts, designs, icons, collection pages, blog content, website copy, and other materials, is owned by or licensed to Chic Teak Inc. and is protected by copyright, trademark, trade dress, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, display, scrape, download, republish, transmit, sell, resell, or commercially exploit our content without our prior written permission.
Use of our website does not grant you any ownership interest or license in our intellectual property except for the limited right to access and use the website for personal, non-commercial shopping purposes.
Section 18 — Prohibited Uses
In addition to other prohibitions set forth in these Terms of Service, you are prohibited from using the site or its content:
- For any unlawful purpose
- To solicit others to perform or participate in unlawful acts
- To violate any international, federal, state, provincial, or local law, rule, regulation, or ordinance
- To infringe upon or violate our intellectual property rights or the intellectual property rights of others
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, threaten, or discriminate

Section 19 — Disclaimer of Warranties
We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, accurate, or error-free.
We do not warrant that the results obtained from use of the Service will be accurate or reliable.
You agree that from time to time we may remove the Service for indefinite periods or cancel the Service at any time, without notice to you.
Except as expressly stated by us in writing, the Service and all products and services delivered through the Service are provided “as is” and “as available” without any representation, warranties, or conditions of any kind, either express or implied.
To the fullest extent permitted by law, we disclaim all implied warranties or conditions, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
Nothing in these Terms is intended to limit any rights you may have under applicable consumer protection laws that cannot be waived or limited by contract.
Section 20 — Limitation of Liability
To the fullest extent permitted by law, Chic Teak Inc., La Place USA, our directors, officers, employees, affiliates, agents, contractors, suppliers, service providers, licensors, and partners shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, consequential, or similar damages of any kind.
This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, loss of use, business interruption, or similar damages, whether based in contract, tort, negligence, strict liability, or otherwise, arising from your use of the Service, inability to use the Service, purchase or use of any product, delivery delay, product variation, website error, or any other claim related to the Service or products.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions our liability shall be limited to the maximum extent permitted by law.
Section 21 — Indemnification
You agree to indemnify, defend, and hold harmless Chic Teak Inc., La Place USA, and our parent companies, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, employees, and representatives from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of:

- Your violation of any law or regulation
- Your violation of the rights of a third party
- Your misuse of the website, Service, products, or content
- Your submissions, reviews, comments, photos, or other user content
Section 22 — Severability
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, such provision shall nevertheless be enforceable to the fullest extent permitted by applicable law.
The unenforceable portion shall be deemed severed from these Terms, and such determination shall not affect the validity and enforceability of any remaining provisions.
Section 23 — Termination
The obligations and liabilities of the parties incurred prior to termination shall survive termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms at any time by notifying us that you no longer wish to use our Services or by ceasing use of our website.
If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services or any part thereof.
Section 24 — Entire Agreement
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service, together with any policies or operating rules posted by us on this site or referenced herein, constitute the entire agreement and understanding between you and Chic Teak Inc. and govern your use of the Service.
These Terms supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us, including any prior versions of the Terms of Service.
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
Section 25 — Governing Law and Venue
These Terms of Service and any separate agreements whereby we provide products or services to you shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to conflict-of-law principles.
To the extent permitted by applicable law, any dispute arising out of or relating to these Terms, your use of the website, or your purchase of products from Chic Teak Inc. through La Place USA shall be brought in the state or federal courts located in Baldwin County, Alabama, unless otherwise required by law.
